Terms of Service & Privacy Policy for PostMiles by Cotopaxi Labs, LLC

It is important that you read the the following terms of service carefully.

These Terms of Service (“Terms”) govern your access and use of the mobile application available under the name PostMiles, services made available to you on, through or in association with the Sites or Cotopaxi Lab’s application (”PostMiles”, the “Services”). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. By using the PostMiles application or any of the services of Cotopaxi Labs, LLC you are agreeing to be bound by the following terms and conditions. You can review the most current version of the Terms of Service at any time at here. Cotopaxi Labs reserves the right to update and change the Terms of Service at any time without notice. Should you continue to use the Service after any such modifications have been made, this shall constitute your agreement to such modifications. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you. If you are or become dissatisfied with these terms or any rules, policies, guidelines or practices applicable to the Service, your sole and exclusive remedy is to discontinue use of the Service.

Violation of any part of the Terms of Service will result in termination of your account.

Account Terms

• You may not use PostMiles for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of The United States.

• A breach or violation of any of the Account Terms as determined in the sole discretion of Cotopaxi Labs, LLC will result in an immediate termination of your services.

• Cotopaxi Labs, LLC may refuse service to anyone for any reason at any time.

General Conditions

1. You must read, agree with and accept all of the terms and conditions contained in this User Agreement before you may become a subscriber of PostMiles.

2. Your use of the Service, including any content, information or functionality contained within it, is provided “as is” and “as available” with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service.

3. We reserve the right to modify or terminate the Service for any reason, without notice at any time.

4. Technical support is only provided to paying account holders and is only available via email.

5. You may not use the service to store, host, or send unsolicited email (spam), SMS messages, or any other unsolicited communication.

6. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.

7. You understand that the Service can be used for transmission of your Content (not including credit card information), and that during processing, your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

8. Cotopaxi Labs, LLC makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv), the accuracy of mathematical calculations performed by the Service, and (v) that bugs or errors in the Service will be corrected.

9. Cotopaxi Labs, LLC, its affiliates and its sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.

10. If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.

11. The failure of Cotopaxi Labs, LLC to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Service sets forth the entire understanding between you and Cotopaxi Labs, LLC as to the Service and supersedes any prior agreements between you and Cotopaxi Labs, LLC (including, but not limited to, prior versions of the Terms of Service).

12. We reserve the right to provide our services to your competitors and make no promise of exclusivity in any particular market segment.

User Content

The Sites or Services may provide features that allow you and other users to post or submit content (“User Content”) to or through the Sites or Services, including, without limitation, messages, commentary, documents, images, video, audio, software, files or other information or content. You retain all ownership rights to your User Content. You are solely responsible for User Content that you post or submit to or through the Sites or Services. Cotopaxi Labs, LLC does not monitor or approve User Content that is posted or submitted to or through the Sites or Services. Cotopaxi Labs, LLC may but is not required to, in its sole and unfettered discretion, edit, remove or delete any User Content that you post or submit to or through the Sites or Services. Cotopaxi Labs, LLC is not responsible for, and does not endorse, any User Content made available on or through the Sites or Services. Under no circumstances shall any Cotopaxi Labs, LLC Related Party (defined below) be held liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to you or any third party in connection with any User Content posted by a third party on or through the Sites or Services. Privacy

Cotopaxi Labs, LLC ("we", "our") is committed to protecting your privacy. This privacy policy ("Policy") describes how Cotopaxi Labs, LLC collects, uses, and secures your personal information when using our services. This Policy applies to the PostMiles mobile application (the “Service”, the “app”).

What We Collect

Information You Provide to Us

We do not collect any personally identifiable information. Your queries to the service are transmitted but the contents of those queries are not recorded.

Information We Collect Automatically

Log Information

Like most online service providers, we collect information that web browsers, mobile devices, and servers typically make available, language preference, referring site, the date and time of access, operating system. We do record, for analytics purposes, the screens accessed and actions taken within the account. Those actions are anonymous and used to improve the user experience of the application.

Usage Information

We collect information about your usage of our services. For example, to handle support in our Product we use a third-party service called Intercom that enables us to interact with our customers via chat and email. This third-party service collects information about how often our customers use our Product and which parts of our Product receive the most (and least) usage. We use this information to improve our existing services and to prioritize new features and services for the future. Another example is our use of Google Analytics on our Site, a third-party service that helps us monitor traffic patterns on our Site. We use this information to help us optimize the content and structure of our Site to be as useful as possible to our visitors.

We use information about you as mentioned above for the purposes listed below:

• To provide our services. For example, to set up, maintain, and backup your Product account, including providing the functionality of the features made available via our services.

We do not sell or share our users' personal information. We do not collect personal information on any users.

We are based in the United States, and as such the information about you that we process when you use our services in the EU will be processed by parties operating outside the European Economic Area (EEA).
